Payment, Fuel, Booking and Charter Rules

These Terms & Conditions govern all bookings, rentals, and charter services provided by CharterMNE through chartermne.com, direct messages, email, phone, WhatsApp, Instagram @chartermne, or any other booking channel used by the Company.
By confirming a booking, paying a deposit, paying the charter fee, boarding the vessel, or using any service provided by CharterMNE, the Client confirms that they have read, understood, and accepted these Terms & Conditions.
1. Definitions
For the purpose of these Terms & Conditions:
- Company means CharterMNE, operating through chartermne.com and related booking channels.
- Client means the person making the booking and any person acting on behalf of a group.
- Guests means all persons participating in the charter under the Client’s booking.
- Vessel means the yacht, boat, catamaran, speedboat, or any other watercraft booked through CharterMNE.
- Charter means the agreed rental period, service, tour, transfer, or private trip provided by CharterMNE.
- Captain / Skipper / Crew means the person or persons assigned to operate or assist with the Vessel.
2. Booking Confirmation
A booking is considered confirmed only when all of the following conditions are met:
- the requested date, vessel, route, and charter details have been agreed;
- the required deposit or prepayment, if applicable, has been received by CharterMNE;
- the Client receives written confirmation from CharterMNE.
A provisional hold on a vessel or date does not constitute a confirmed booking unless expressly confirmed in writing by CharterMNE.
CharterMNE reserves the right to release any unconfirmed booking request without notice.
3. Charter Price
The charter price is the amount stated in the written offer, invoice, booking confirmation, or direct message confirmation issued by CharterMNE.
The charter price includes only those items expressly listed as included in the confirmed offer.
Unless otherwise stated in writing, the charter price may exclude:
- fuel;
- marina fees;
- port fees;
- berth or dockage fees;
- skipper or crew fees, where separately charged;
- VAT or taxes, where applicable and not expressly included;
- catering and drinks;
- hostess service;
- DJ, photographer, videographer, decorations, flowers, or event setup;
- water toys and special equipment;
- hotel, transfer, or pickup services;
- entrance tickets and destination fees;
- overtime;
- route extensions;
- waiting time charges;
- cleaning charges resulting from unusual condition of the vessel after use;
- damages caused by the Client or Guests.
No verbal statement shall modify the agreed price unless confirmed by CharterMNE in writing.
4. What Is Included / What Is Not Included
To avoid any misunderstanding, the Client must review the booking confirmation carefully.
Included
Only the services and items expressly stated in the written confirmation are included.
Examples may include:
- use of the vessel for the agreed duration;
- captain/skipper, where specified;
- standard onboard equipment;
- towels, soft drinks, or welcome package, where specified;
- standard route described in the offer.
Not Included
Unless expressly stated otherwise, the following are not included:
- fuel;
- extra navigation outside the standard route;
- extended charter hours;
- waiting time;
- custom pickup/drop-off points;
- catering or premium beverages;
- celebration/event setup;
- extra staff;
- marina and port charges;
- overnight stays;
- accommodation;
- transportation to or from the marina;
- special requests not listed in the booking confirmation.
The Client is responsible for clarifying any uncertainty before payment or boarding.
5. Payment Methods
The Client may pay CharterMNE using one of the following payment methods, subject to availability, booking type, amount, operational approval, and compliance checks where required.
5.1. Bank Transfer
The following bank transfer methods may be accepted:
- SEPA
- SWIFT
- Wire Transfer
- Lovćen Banka
- Adriatic Serbia
- Freedom Finance
- SBP (Raiffeisenbank)
- T-Bank (RUB)
5.2. Online Payment
The following online payment methods may be accepted:
- Debit / Credit Card via secure payment link
- Apple Pay
- PayPal
- Revolut
- Revolut QR
- Wise
5.3. Crypto Payments
The following cryptocurrency payment methods may be accepted, subject to prior confirmation by CharterMNE:
- USDT
- Bitcoin
Where cryptocurrency is accepted, the applicable exchange rate, wallet details, network, transfer timing, and confirmation procedure shall be communicated by CharterMNE before payment. Any blockchain, exchange, conversion, gas, wallet, intermediary, or transfer fees shall be borne by the Client unless otherwise agreed in writing.
5.4. Other Payment Methods
The following additional payment methods may be accepted:
- Cash
- Invoice
- Company Invoice
5.5. Accepted Currencies
Unless otherwise agreed in writing, CharterMNE may accept payments in the following currencies:
- EUR €
- USD $
- GBP £
If payment is made in a currency different from the invoiced currency, the final received amount must match the invoiced amount after currency conversion, correspondent bank charges, payment provider fees, and transfer costs. Any shortage caused by conversion or transfer fees shall be paid by the Client.
5.6. Payment Approval and Verification
CharterMNE reserves the right to:
- approve or reject a payment method for a specific booking;
- request payment through a specific method;
- request proof of payment;
- request payer identification for compliance, anti-fraud, invoicing, or accounting purposes;
- refuse boarding until cleared funds are received, where applicable.
A booking is not considered fully paid until the relevant amount has been received and confirmed by CharterMNE.
5.7. Payment Fees
Any bank charges, payment gateway fees, currency conversion costs, intermediary bank fees, crypto transfer fees, or similar charges imposed outside CharterMNE shall be borne by the Client unless expressly agreed otherwise in writing.
6. Deposit and Advance Payment
CharterMNE may require a deposit or advance payment in order to secure the booking.
Unless otherwise agreed in writing:
- the deposit is non-refundable in the event of cancellation by the Client within the cancellation period stated in these Terms or in the specific booking confirmation;
- the remaining balance must be paid in accordance with the payment terms stated in the booking confirmation.
If the Client fails to pay the required deposit within the stated deadline, CharterMNE may cancel the provisional booking and release the vessel to other clients.
7. Payment Before Boarding
Unless expressly agreed otherwise in writing, all outstanding charter amounts must be paid before boarding.
CharterMNE reserves the right to:
- refuse boarding;
- delay departure;
- suspend services;
- cancel the charter
if the required amount has not been received in full before embarkation.
Any delay caused by incomplete payment does not extend the charter duration.
8. Payment at Boarding
If CharterMNE expressly allows payment at boarding, the following rules apply:
- the remaining charter balance must be paid in full immediately before embarkation;
- payment must be completed before the vessel leaves the marina, dock, or pickup point;
- CharterMNE may refuse boarding until full payment is received;
- payment at boarding is valid only if confirmed in writing by CharterMNE;
- if the Client arrives late and the payment process delays departure, the lost time is included in the booked charter time and is not added at the end unless CharterMNE agrees otherwise in writing.
Payment at boarding does not mean payment after departure unless CharterMNE has clearly approved that arrangement.
9. Fuel Policy
Fuel is one of the most important variable costs in yacht and boat charter operations.
Unless explicitly stated in writing that fuel is included, fuel is charged separately.
Fuel costs may vary depending on:
- vessel type;
- engine size and consumption;
- sea conditions;
- weather conditions;
- route distance;
- cruising speed;
- detours or route changes;
- waiting time with engines running;
- number of transfers or pickup points.
CharterMNE aims to communicate fuel policy clearly before the trip, but the final amount may depend on the actual use of the vessel.
10. Fuel Settlement Method
Depending on the vessel, trip format, and booking type, CharterMNE may use one of the following fuel settlement methods:
10.1. Estimated Fuel in Advance
A fuel estimate may be provided before the trip based on the planned route and expected operational conditions.
This estimate is indicative only unless expressly confirmed as fixed.
10.2. Fuel Charged by Actual Consumption
Fuel may be charged according to actual use of the vessel during the charter.
Actual consumption may be determined by:
- onboard monitoring systems;
- engine hours;
- standard vessel consumption rates;
- route traveled;
- refueling amount after the trip.
10.3. Fixed Fuel Supplement
For selected routes, packages, or promotions, CharterMNE may apply a fixed fuel supplement agreed in advance.
This fixed supplement applies only to the agreed standard route and duration. Any deviation may result in additional fuel charges.
10.4. Refueling-Based Calculation
In some cases, the vessel may be refueled after the charter and the amount of fuel added may be used as the final settlement basis.
CharterMNE may select the method most suitable for the specific vessel and booking, provided that the method is reasonable and commercially standard for the trip.
11. Fuel Payment at the End of the Trip
If fuel has not been prepaid or included in the package, the Client shall pay the fuel cost at the end of the trip.
Fuel payment shall be made:
- before final disembarkation, or
- immediately after CharterMNE presents the calculation, invoice, or amount due.
If the Client refuses or fails to pay fuel charges due at the end of the trip, CharterMNE reserves the right to take all lawful steps to recover the outstanding amount, including invoicing, debt collection, and legal action.
Where the charter duration is extended or the route is changed at the Client’s request, the fuel charge shall be adjusted accordingly.
12. Route Changes and Additional Fuel Use
The agreed price and any fuel estimate are based on the confirmed route, duration, departure point, and expected trip profile.
Additional fuel and extra charges may apply if the Client requests:
- a longer route;
- an unplanned destination;
- additional pickup or drop-off points;
- higher cruising speed;
- longer waiting time;
- extended swimming stops requiring repositioning;
- late return;
- any operational change affecting vessel use.
All such additional amounts are payable by the Client at the end of the trip unless otherwise agreed.
13. Extras and Additional Services
Any extra services requested by the Client are charged separately unless expressly included in the written confirmation.
Extras may include, but are not limited to:
- catering;
- premium drinks or alcohol service;
- event decoration;
- hostess;
- photographer or videographer;
- DJ or entertainment;
- transfer service;
- flower arrangements;
- water toys;
- special route planning;
- celebratory setup;
- waiting charges;
- marina and docking charges outside the standard route.
Extra services are subject to availability and operational feasibility.
Where extra services are ordered in advance, payment may be required before boarding. Where extra services are ordered during the trip, payment may be due immediately or at the end of the trip, as instructed by CharterMNE.
14. Overtime
The charter begins and ends at the times stated in the booking confirmation.
If the trip exceeds the agreed duration due to the Client’s request, lateness, delay, route changes, or additional stops, CharterMNE may charge overtime.
Overtime may include:
- additional vessel use;
- additional crew time;
- extra fuel;
- additional port or marina costs.
Overtime is charged at the rate communicated by CharterMNE for the specific vessel or, if no rate was communicated in advance, at a reasonable commercial hourly rate determined by CharterMNE.
CharterMNE is not obliged to approve overtime if:
- the vessel has another booking;
- weather or sea conditions make extension unsafe;
- port or marina restrictions apply;
- crew operational limits prevent extension.
15. Security Deposit
For certain vessels, CharterMNE may require a refundable security deposit before boarding.
The amount, payment method, and release conditions of the security deposit will be specified before the charter.
The security deposit may be used to cover:
- damage to the vessel;
- missing equipment;
- extraordinary cleaning costs;
- unpaid fuel;
- unpaid overtime;
- unpaid marina or route-related charges;
- any loss caused by the Client or Guests.
If the total damage or outstanding charges exceed the security deposit amount, the Client remains fully liable for the difference.
16. Damage Liability
The Client is responsible for any loss, damage, or expense caused by the Client or Guests through:
- negligence;
- reckless behavior;
- intentional misconduct;
- violation of crew instructions;
- misuse of onboard equipment;
- bringing prohibited items onboard;
- unsafe boarding or disembarkation behavior.
The Client shall indemnify CharterMNE for all direct costs reasonably incurred as a result of such damage, including repair, replacement, cleaning, transport, and downtime losses where applicable under law.
Normal wear and tear is excluded.
17. Guest Conduct Onboard
The Client is responsible for the conduct of all Guests in the booking group.
All Guests must:
- follow the instructions of the captain and crew at all times;
- respect safety procedures;
- behave in a manner appropriate for a premium charter environment;
- avoid damage to the vessel and equipment;
- comply with passenger capacity limits;
- obey all applicable laws and marina rules.
The captain has final authority onboard regarding navigation, safety, passenger conduct, route, and operational decisions.
Failure to follow captain or crew instructions may result in termination of the charter without refund.
18. Alcohol, Illegal Substances, and Dangerous Conduct
CharterMNE reserves the right to refuse boarding or terminate the charter without refund if the Client or any Guest:
- is excessively intoxicated before departure;
- uses or possesses illegal drugs;
- behaves violently, aggressively, or abusively;
- creates safety risks for other Guests, the crew, or the vessel;
- damages property;
- refuses to comply with captain or crew instructions.
Dangerous acts such as unsafe diving, reckless jumping, interfering with navigation equipment, or any behavior that may endanger life, health, or the vessel are strictly prohibited.
19. Late Arrival
The Client must arrive at the agreed meeting point at the agreed time.
If the Client arrives late:
- the charter will still end at the originally scheduled end time unless CharterMNE agrees otherwise;
- CharterMNE is not obliged to extend the trip;
- no refund is due for lost time caused by the Client’s delay.
If the Client’s lateness causes operational disruption, route reduction, extra waiting, or cancellation of planned stops, CharterMNE shall not be liable for such consequences.
20. No-Show
If the Client fails to arrive at the agreed boarding location within the waiting period communicated by CharterMNE, the booking may be treated as a no-show.
In case of no-show:
- the charter may be canceled;
- the full booking amount may be retained;
- no refund is guaranteed;
- CharterMNE may release the vessel for other operational use.
Any exception shall be solely at CharterMNE’s discretion.
21. Weather Policy
Safety is the highest priority in every CharterMNE operation.
The captain and/or CharterMNE may change, postpone, shorten, interrupt, reschedule, or cancel the charter if required due to:
- weather conditions;
- rough sea;
- strong wind;
- visibility issues;
- port authority instructions;
- technical reasons;
- safety concerns affecting Guests, crew, or the vessel.
The captain’s decision on safety and navigational matters is final.
If a weather-related or safety-related adjustment is necessary, CharterMNE may, depending on the circumstances and operational possibilities:
- offer a revised route;
- offer a revised departure time;
- offer rescheduling;
- offer a credit note;
- offer an alternative vessel where possible;
- offer a partial refund where appropriate;
- offer a full refund where the charter cannot take place at all and no reasonable alternative is accepted.
No compensation shall be due for indirect losses such as hotel expenses, flights, transport, celebrations, missed reservations, or similar costs not directly charged by CharterMNE.
22. Company Right to Change Vessel or Route
CharterMNE reserves the right, where reasonably necessary, to substitute the booked vessel with another vessel of similar category, capacity, or standard.
This may happen due to:
- technical issues;
- safety concerns;
- operational requirements;
- force majeure;
- previous vessel damage;
- crew or marina restrictions.
If no suitable substitute is available, CharterMNE may propose rescheduling, credit, or refund, depending on the circumstances.
Routes may also be changed due to safety, weather, congestion, restricted access, operational needs, or authority instructions.
23. Cancellation by the Client
Unless a different cancellation policy is stated in the specific booking confirmation, the following default rules apply:
- cancellation more than 14 days before the charter date: amounts paid may be refunded minus bank charges, card fees, and administrative costs;
- cancellation 7 to 14 days before the charter date: partial refund may be offered at CharterMNE’s discretion, depending on the vessel, season, and possibility of rebooking the date;
- cancellation less than 7 days before the charter date: no refund;
- no-show: no refund.
If the Client requests a date change instead of cancellation, CharterMNE may accommodate the request subject to availability, price difference, and operational feasibility.
Date changes are not guaranteed.
24. Cancellation by CharterMNE
CharterMNE may cancel the charter before departure if:
- weather or sea conditions make the trip unsafe;
- the vessel is unavailable due to technical reasons;
- the Client fails to make payment as required;
- the Client or Guests present a safety or conduct risk;
- force majeure occurs;
- the authorities restrict or prevent the charter.
In such cases, CharterMNE may offer one of the following remedies, depending on the situation:
- rescheduling;
- another vessel;
- route adjustment;
- booking credit;
- partial refund;
- full refund of amounts paid for the canceled charter.
This remedy shall be the Client’s sole contractual remedy unless mandatory law provides otherwise.
25. Personal Belongings
Clients and Guests are responsible for their personal belongings at all times.
CharterMNE is not liable for:
- lost items;
- stolen items;
- wet or damaged personal belongings;
- items forgotten onboard after disembarkation,
unless directly caused by proven gross negligence of CharterMNE.
Clients are advised not to bring valuables unless necessary.
26. Health and Fitness to Travel
The Client is responsible for ensuring that all Guests are physically fit to participate in the charter.
The Client must inform CharterMNE in advance of any relevant medical condition, mobility issue, pregnancy-related restriction, or special requirement that may affect safe participation.
CharterMNE may refuse boarding where participation may present a safety risk to the individual, other Guests, crew, or vessel.
27. Children and Minors
Children and minors are welcome only under the supervision and responsibility of a parent or legal guardian.
The Client is fully responsible for the safety, conduct, and supervision of minors in the group.
The captain may require specific safety measures for minors, including life jacket use at any time.
28. Complaints Procedure
If the Client has any complaint regarding the vessel, route, crew, or service, the complaint must be communicated immediately during the charter so that CharterMNE has a fair opportunity to resolve the matter on the spot.
Complaints raised only after disembarkation may be considered only where it was not reasonably possible to raise the issue earlier.
Any post-charter complaint should be submitted in writing within a reasonable period after the trip and should include:
- booking details;
- date of charter;
- vessel name, if known;
- description of the issue;
- supporting evidence, where available.
29. Force Majeure
CharterMNE shall not be liable for any delay, cancellation, route change, service reduction, or failure to perform caused by events beyond its reasonable control, including but not limited to:
- storms and severe weather;
- natural disasters;
- war;
- civil unrest;
- strikes;
- epidemics or pandemics;
- government measures;
- border restrictions;
- port closures;
- authority intervention;
- accidents;
- technical failures not caused by CharterMNE’s wilful misconduct;
- supplier failure beyond reasonable control.
In such cases, CharterMNE will use reasonable efforts to offer a practical alternative, such as rescheduling or credit, where commercially possible.
30. Photos, Videos and Marketing
CharterMNE may occasionally capture general atmosphere photos or videos for marketing purposes.
If the Client does not wish to appear in promotional material, the Client must notify CharterMNE before departure.
Where a private event or discreet charter is booked, CharterMNE will make reasonable efforts to respect privacy expectations as agreed in advance.
31. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and interpreted in accordance with the laws applicable in Montenegro.
Any dispute arising out of or in connection with a booking or charter shall be submitted to the competent court in Montenegro, unless mandatory consumer protection law requires otherwise.
32. Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
33. Entire Agreement
These Terms & Conditions, together with the written booking confirmation, invoice, and any expressly agreed written addendum, constitute the entire agreement between the Client and CharterMNE regarding the charter.
No oral statements or informal messages shall override these Terms unless expressly confirmed in writing by CharterMNE.
34. Acceptance
By paying through any of the available payment methods offered by CharterMNE, including bank transfer, online payment, crypto payment, cash, invoice, or company invoice, the Client confirms that they have read, understood, and accepted these Terms & Conditions in full on behalf of themselves and all Guests included in the booking.
Any payment made to CharterMNE shall be deemed as full acceptance of these Terms & Conditions.
